Legal
information
Of interest, related to the activities of this website. If anything here is unclear, write to [email protected] and I will explain it in plain words.
Terms and conditions of use
This website is operated by Nico Photography, a photography business based in Sydney, New South Wales, Australia. By browsing this site, sending an enquiry through it or booking a session, you accept the terms set out below. If you do not accept them, please do not use the site.
What this site is for
The site exists to show published photographic work and to let you get in touch about a session. It does not process payments and it does not create a user account for you. Enquiries arrive by WhatsApp or by email, and a booking only exists once it has been agreed directly between you and Nico.
Information shown here
The descriptions of each kind of session, what each one includes and how it is quoted are published in good faith and kept as accurate as possible, but they are a guide and not a binding offer. The final scope, price and delivery date of a session are the ones agreed in writing with you before the session takes place, and those prevail over anything stated on this site.
Third-party services
Some parts of this site rely on services operated by others: the galleries are delivered through an external image hosting service, the typefaces are loaded from Google Fonts, and the contact buttons open WhatsApp, your email client or Instagram. Once you leave this site through one of those links, the terms and privacy policy of that service apply, not this one.
Availability and liability
Every reasonable effort is made to keep this site available and free of errors, but it is provided as it is, without warranty of uninterrupted or fault-free operation. Nico Photography is not liable for indirect loss arising from the use of the site or from a temporary interruption to it. Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded.
Changes to these terms
These terms may be updated to reflect changes in the service or in the applicable law. The version published on this page is the one in force, and the date of the last revision appears at the end of this document.
Governing law
These terms are governed by the laws of New South Wales, Australia, and any dispute arising from them is subject to the courts of that jurisdiction.
Photographs and copyright
Ownership
Every photograph published on this site was taken by Nico and is protected by copyright under the Copyright Act 1968 (Cth). Ownership of the images stays with the photographer, including the photographs delivered to a client after a session, unless something different has been agreed in writing.
What you may not do
- Download, copy or republish the images, in whole or in part, on any website, social network, printed piece or commercial material.
- Edit, crop, apply filters to or otherwise alter a photograph, or remove the credit from it.
- Use any image to train, fine-tune or evaluate an automated or artificial intelligence system.
- Sell, license or transfer an image to a third party.
If you would like to use a photograph for something, write and ask. Permission is often given; it simply has to be given.
People who appear in the photographs
The galleries on this site are published with the agreement of the people who appear in them. Where a photograph shows a person under 18, it is published with the consent of a parent or guardian. If you appear in a photograph on this site and would prefer it were not published, write to [email protected] and it will be taken down, without you having to give a reason.
Your own photographs
The photographs from your session are yours to enjoy, print and share in your own personal accounts, with the credit kept. What is not included, unless agreed in writing, is commercial use: advertising, resale, or use by a brand or a third party.
Privacy policy
This policy explains what personal information Nico Photography collects through this website, what it is used for and what rights you have over it. It is written to comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles, and, for visitors in the European Union, with the General Data Protection Regulation.
What information is collected
You can browse this entire site, including every gallery, without giving any personal information. Information is only collected when you choose to make contact, and it is only what you yourself write: typically your name, your phone number or email address, and whatever you tell about the session you have in mind — the date, the place and the kind of event.
What it is used for
- Replying to your enquiry and preparing a quote.
- Agreeing, organising and carrying out the session.
- Delivering the photographs and answering anything that follows.
- Meeting accounting and tax obligations, where a session goes ahead.
Your information is not used to send marketing you did not ask for, and it is not sold, rented or traded. It is only disclosed to a third party where the law requires it.
How long it is kept
An enquiry that does not lead to a booking is kept only as long as the conversation is live. Where a session goes ahead, the records associated with it are kept for as long as Australian tax law requires them to be kept, and then deleted.
How it is protected
Your information is held in accounts protected by access control and is shared with no one outside the business. The connection to this site is encrypted. No system connected to the internet can be declared completely secure, but any incident affecting your information would be handled, and notified, as the Notifiable Data Breaches scheme requires.
Your rights over your information
- Ask what information is held about you.
- Ask for it to be corrected if it is wrong.
- Ask for it to be deleted.
- Withdraw consent for a photograph in which you appear to remain published.
- Object to a particular use of it.
Write to [email protected] and you will have an answer within 30 days. If you are not satisfied with that answer, you may take the matter to the Office of the Australian Information Commissioner.
Children
This site is not directed at children, and no information is knowingly collected from anyone under 16. Where a session involves a minor, it is arranged with a parent or guardian, and their consent covers both the session and the publication of the photographs.
Changes to this policy
This policy may be updated to reflect changes in the service or in the applicable law. The version published here is the one in force.
